Cascade FM, LLC (together with its affiliates, the “Company”) respects the importance of individual privacy, and we value the confidence of our customers and other visitors to the website located at www.cascade.fm (the “Website”).  

This Privacy Statement will assist you to understand what types of information we may collect through the Website, how that information may be used, and with whom the information may be shared.  This Privacy Statement does not govern the information collection, handling or use of any other website or platform other than this Website.

2. COLLECTING AND USING YOUR DATA

In the course of your use of this Website, the Company may collect personal information about you including, without limitation: (1) your first and last name, (2) your birth date, (3) your mailing address, (4) your e-mail address, (5) your telephone number, and (6) your credit card information.  The Company may collect personal information directly through information you provide us via the Website and/or through third party social media networks, such as Facebook™, should you choose to set up an account with the Company through any such third party social media service.
The Company also collects non-personally identifiable information about Website users, including, without limitation:  (1) domain information, (2) internet protocol (IP) addresses, (3) location data, (4) information concerning browser types and operating systems, (5) date, time and frequency of access information, (6) information regarding specific Website pages visited, and (7) other non-personally identifiable information collected through data aggregators and public databases, which could include demographic information and information concerning users’ other online activities.

We use “cookies” to collect non-personally identifiable information. Cookies are small files that are placed on your hard drive by the Website for identification purposes. Any voluntary personal or other information that you make available through the Website, including, without limitation, material you place in your user profile, or by posting a review of content of the Website, including Artist Materials, Submissions, or any information that you email the Company will be treated as non-confidential, collected by the Company, and potentially shared with other users of the Website.

The Company also uses information collected via the Website to send emails to users of the Website regarding the Company’s products, services and promotions. Email recipients may OPT OUT at any time by clicking on the “unsubscribe” instructions included in each email message, or by emailing the Company at: support@cascade.fm. The Company shall remove you from the Company’s email list within a reasonable amount of time after receipt of actual notice of your request to be removed.

3. NO COLLECTION OF DATA FROM USERS UNDER 13

The Company does not knowingly collect or maintain personally identifiable information from persons under the age of 13, and no part of the Company’s Website is directed to, or intended to be, accessed by, persons under the age of 13. If the Company obtains actual knowledge that personally identifiable information of persons under 13 years of age has been collected, the Company will take immediate appropriate steps to delete such information.

4. CREDIT CARD PROCESSING

The Company has partnered with Authorize.net, a leading credit card payment gateway, to offer safe and secure credit card transactions for our customers. When you register for a paid subscription through the Website, Authorize.net provides your name, billing address, and credit card information, along with the amount to be charged, to the bank that processes your credit card for billing purposes. This process is protected by an enhanced security system, utilizing industry-leading technologies and protocols, such as 128-bit Secure Sockets Layer (SSL), and Authorize.Net is compliant with relevant government and industry security initiatives.

The Company does not keep any credit card information on our servers. This information is kept by Authorize.net in secure databases in compliance with the Payment Card Industry Data Security Standard (“PCI DSS”) and will be used with your authorization for recurring billing. For more information regarding Authorize.net and their security practices, please review the Authorize.net Privacy Policy at www.authorize.net.   Notwithstanding anything to the contrary contained in this Privacy Statement, you acknowledge and agree that the Company is not responsible for the privacy practices of Authorize.net.

5. SECURITY AND STORAGE

The Company uses a variety of commercially reasonable safeguards to seek to preserve the security of the personally identifiable information collected from the Website, including, appropriate encryption technology.  The Company is committed to protecting your privacy in accordance with applicable laws and regulations. Notwithstanding the foregoing, no electronic transmission of information can be guaranteed to be 100% safe, and the Company cannot and does not ensure or warrant the security of any information you transmit to the Company. You acknowledge that all information you transmit to the Company via the Website or otherwise is done at your own peril.

If you use the Website outside of the United States, please be aware that any information the Company or its licensees or partners collect may be transferred to, stored, and/or processed in the United States.

This Website may contain links to other third party websites.  You acknowledge that the Company has not reviewed these third party websites, has no control over these third party websites or the content thereof, and is not responsible for any of these sites or their content.  Accordingly, you acknowledge and agree that access to any third party website is at your own risk and the Company shall have no liability therefor.

The Company is not responsible for the privacy practices of any websites or platforms that are not owned or operated by the Company, including, without limitation, any third-party website or other platform that may be co-branded with the Company’s name. This Privacy Statement does not govern the information collection, handling or use of any other website other than this Website.

This Privacy Statement became effective as of the date set forth above.  The Company reserves the right to make changes to this Privacy Statement from time to time.  We will update the effective date posted at the top of this webpage and post an updated Privacy Statement for any changes we make.  Any changes to this Privacy Statement are effective immediately after being posted by the Company.  We recommend that all visitors and users of this Website re-visit this Privacy Statement occasionally to learn of any new privacy practices or changes to our policies.  Your continued use of this Website constitutes an act of acceptance of any changes to this Privacy Statement.
